Australia Needs a Constitutional Council

As the Australian government seeks to establish a more efficient and cooperative model of federalism it is appropriate to consider how this could be locked into our system of government and not just be a fad of the times.

Our Constitution is in need of considerable change in order to reflect the nation we are today, and the one we aspire to be in the future. To do so we need to develop a path that educates, earns public trust and promotes required change.

The establishment of a permanent Constitutional Council of eminent citizens is a way of achieving this.

Can you offer examples of changes that are needed? Constitutions are very difficult to change.

Changes needed to unambiguously define roles between federal and state governments - and define the role of local government councils.

Clarity needs to be given to tax and the funding of each layer of government.

Sections covering "inherited" citizenship and "allegiance" need review given the large proportion of Australians being 1st or 2nd generation migrants.

Indigenous recognition.

These are just a few of the many issues that require attention.

Constitutional Law expert and Scientia Professor George Williams has proposed another exciting idea for Australia’s governance. That is, to explore the opportunities our constitution offers and that the conventions with the Crown provide for selecting and appointing our Governor General. Prof Williams raises several interesting issues regarding the potential powers of the position and alternative ways of selecting and appointing a Governor General. Public discourse over these issues could catalyse community interest in our country’s governance and help us evaluate options for constitutional refreshment and our head of state's role, status and powers.
